Terms of Service

1. The Service

HomeCrew provides cloud-based software for domestic staffing agencies to manage staff records, payroll, client placements, invoicing, and self-service HR functions. The service is provided on a subscription basis and accessed via web browser.

2. Account Registration

• You must provide accurate information when registering. One account represents one organisation.
• You are responsible for keeping your login credentials secure. Do not share your password.
• You must be at least 18 years old and authorised to enter contracts on behalf of your organisation.
• We reserve the right to suspend accounts that provide false information or violate these terms.

3. Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start. At the end of the trial, continued access requires a paid subscription. Trial data is retained for 30 days after the trial period before deletion.

4. Subscriptions & Billing

• Subscriptions are billed monthly. Pricing is agreed upon when your account is set up.
• Payment is due at the start of each billing period. Accounts with overdue balances may be suspended after a 7-day grace period.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — no refunds are issued for partial months.
• We reserve the right to update pricing with 30 days' written notice by email.

5. Your Data

You own your data. HomeCrew processes your staff, client, and payroll data on your behalf as a data processor under Kenya's Data Protection Act, 2019. We do not claim ownership of any data you input into the platform.

You are responsible for ensuring that you have the legal right to input personal data about third parties (staff, clients) into the platform, and that affected individuals have been informed appropriately.

6. Acceptable Use

You agree not to:

• Use HomeCrew for any unlawful purpose or in violation of Kenyan law.
• Attempt to gain unauthorised access to other accounts, the database, or the underlying infrastructure.
• Upload malicious code, viruses, or scripts designed to disrupt the service.
• Reverse-engineer, decompile, or copy any part of the platform.
• Resell or sublicense access to HomeCrew without our written consent.
• Use automated tools to scrape or extract data from the platform at scale.

Violations may result in immediate account suspension without refund.

7. Uptime & Service Availability

We target 99.5% monthly uptime for the platform, excluding scheduled maintenance. Scheduled maintenance windows will be notified at least 24 hours in advance by email where possible.

We are not liable for downtime caused by third-party providers (AWS, internet infrastructure) or events outside our reasonable control.

8. Confidentiality

Both parties agree to keep the other's confidential information private. We will not disclose your business data, staff records, or payroll information to any third party except as described in our Privacy Policy or as required by Kenyan law.

9. Limitation of Liability

To the fullest extent permitted by Kenyan law:

• HomeCrew is provided "as is." We make no warranties that the service will be error-free or uninterrupted.
• We are not liable for any indirect, incidental, or consequential loss arising from your use of the platform.
• Our total liability for any claim arising under these terms is limited to the subscription fees you paid in the three months preceding the claim.

Nothing in these terms limits liability for fraud, death, or personal injury caused by our negligence.

10. Intellectual Property

HomeCrew, its design, code, and branding are owned by Digital Cloud Bytes. These terms do not grant you any right to use our trademarks, trade names, or logos outside of normal use of the platform.

11. Termination

Either party may terminate the agreement by giving 30 days' written notice. We may terminate immediately if you materially breach these terms. On termination:

• Your access is revoked at the end of the notice period.
• You may request an export of your data within 30 days of termination. After that, data will be deleted except where we are required by law to retain it.

12. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Kenya. Both parties agree to first attempt resolution through good-faith negotiation before initiating formal proceedings.

13. Changes to These Terms

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance. If you do not accept the changes, you may cancel your account before they take effect.
